Object to a fine
When you travel without a valid ticket, you risk getting a fine. An HTM inspector can also give a fine for eating or drinking in tram or bus as well as for indecent behaviour. The Centraal Justitieel Incasso Bureau (CJIB) is in charge of settling the fine (not HTM).
How to object to the fine?
Within 14 days you can object to the fine by letter or by e-mail. HTM can only register your objection when the fine also has been paid within 14 days.
To object to the fine you need to:
- prove that the fine is unfair (evidence of proof)
- prove that the HTM inspector did not take all relevant circumstances into consideration.
It is useless to object when:
- You forgot to check in
- You checked in too late
- You had not enough credit on your OV chip card
- You used someone else’s personal OV chip card
- You did not have sufficient money to buy a ticket
- Your OV chip card was damaged or broken, so that it was inpossible to check in
- You misused the HTM Ticket app during the inspection.
It is strictly forbidden to use the personal OV chip card of someone else. Both in the general conditions for local and regional public transport as well as in the HTM Personenvervoer 2000 decree, is stated explicitly that a personal OV chip card can only be used by the legitimate owner.
The Geschillencommissie Openbaar Vervoer (committee in charge of disputes) has also decided that only the owner of the personal OV chipcard can use his/her own card.
Send a clearly written letter (max 1 page) in which you state why you object to the fine. Mention in the letter your name, address and telephone number, add a copy of the fine, and, if applicable, a clear copy of your OV chip card. Send this to:

Note: the date of receipt determines whether the letter was sent within 14 days and the transfer date of the payment of the fine determines whether you paid within 14 days.

HTM will sent you an acknowledgement of receipt within 14 days and will respond to your letter/email as soon as possible. In the event HTM agrees to your objection, we will refund the paid amount within three weeks.
